Extended Producers Responsibility (EPR) regime is under implementation in Plastic Packaging Waste Management Rules, 2016, according to which it is the responsibility of Producers, Importers and Brand-owners to ensure processing of their plastic packaging waste through recycling, re-use or end of life disposal (such asco-processing/Waste-to-energy/Plasticto-oil/roadmaking/industrial-composting).

Government of India, Ministry of Environment, Forest and Climate Change has notified the Guidelines on Extended Producers Responsibility on plastic packaging under Plastic Packaging Waste Management Rules, 2016. The guidelines on extended producer responsibility coupled with prohibition of identified single use plastic items, which have low utility and high littering potential, with effect from 1st July 2022, Rule 3(f)are important steps for reducing pollution caused due to littered plastic waste in the country.

On Date 08/02/2023 New guidelines, EPR On Producers, Importers and Brand Owners (PIBOs) shall have to register through the online centralized portal developed by the Central Pollution Control Board (CPCB).

New guidelines 08/02/2023 EPR On Producers, Importers and Brand Owners (PIBOs) have been made applicable to both pre-consumer and post consumer plastic packaging waste Schedule II of plastic waste management amendment rules 2022 Person who imports plastic packaging or plastic sheets or like is under  an obligation to get registered on the centralized portal developed by the Central Pollution Control Board (CPCB).

Rule 3(f) Importers means a person who imports plastic packaging product or products with plastic packaging or carry bags or multilayered packaging or Plastics sheets.

Rule 4(II) Importer (I) of all Imported Plastic packaging and /or Plastic packaging of imported products.

In thus emerges that besides the importer of Plastic Packaging the importers of various items such as primary products chemicals machinery textiles articles etc. which are not plastic but coming packed in plastic packaging are also required to take said EPR Plastic Registration.

The Objectives of EPR are as follows:

(1) Integration of environmental costs | (2)  Improved waste management  (3) Reduction of disposal  (4)  Reduction of burden on municipalities   (5) Design of environmentally sound products

The enforceable prescription of minimum level of recycling of plastic packaging waste collected under EPR along with use of recycled plastic content will further reduce plastic consumption and support recycling of plastic packaging waste

The Guidelines prescribe a framework for levy of environmental compensation based upon polluter pays principle, with respect to non-fulfilment of extended producer responsibility targets by producers, importers & brand owners, for the purpose of protecting and improving the quality of the environment and preventing, controlling and abating environment pollution. The funds collected shall be utilized for collection, recycling and end of life disposal of uncollected plastic waste in an environmentally sound manner.

The following entities shall register on the centralized portal developed by CPCB:    

    (I). Producer (P)       (II). Importer     (III). Brand owner (BO)      (IV).  Plastic Waste Processor engaged in

(a) recycling, (b) waste to energy, (c) waste to oil, and (d) industrial composting

The new Rules classify Plastics Packaging into four categories-:

Category 1-  It will include Rigid plastic packaging;(more than one layer with different types of plastic), plastic sheets and covers made of plastic sheet, carry bags, plastic sachet or pouches.

 

Category 2- It will include flexible plastic packaging of single layer or multilayer (more than one layer with different types of plastic), plastic sheets and covers made of plastic sheet, carry bags, plastic sachet or pouches.

Category 3- Multi-layered plastic packaging (at least one layer of plastic and at least one layer of material other than plastic) will come under(more than one layer with different types of plastic), plastic sheets and covers made of plastic sheet, carry bags, plastic sachet or pouches.
Category 4-  Plastic sheet or like used for packaging as well as carry bags made of compostable plastics fall under (more than one layer with different types of plastic), plastic sheets and covers made of plastic sheet, carry bags, plastic sachet or pouches.
